Terms of Use

These Terms of Use govern your use of AI Baby at babykin.io (the “Service”), a website that creates AI photos and videos from the pictures you upload. The Service is operated by MAKA PELKA LTD, 36 Nachmani, 6579505 Tel Aviv-Jaffa, Israel (“we”, “us”). By using the Service you accept these Terms. If you do not accept them, do not use the Service.

1. Who may use the Service

You must be at least 18 years old. You may upload a picture of a child only if you are that child’s parent or legal guardian, or have their permission.

2. Your account and signing in

You sign in with the e-mail address you used to buy your subscription and a one-time code we send to it. Keep access to that mailbox secure: anyone who can read it can sign in as you. We may suspend an account that breaks these Terms.

3. Subscription and payment

  • A subscription is bought in our web checkout. Its price, billing period, trial and renewal are shown there before you pay, and payments are processed by the checkout’s payment providers — card details never reach this site.
  • You may create while your subscription is active or in its trial. Each day comes with an allowance of creations shown in the Service; a video uses more of it than a photo. A creation that fails is not counted.
  • You can cancel at any time from Account → Manage subscription. Cancelling stops future renewals; your access follows the status of your subscription in the checkout.
  • For questions about a charge or a refund, write to [email protected]. Refunds follow the terms shown at checkout and the law that applies to you.

4. Your photos and your creations

You keep the rights to the photos you upload. You give us permission to process them, and to have our processing providers process them, only to make the creations you ask for and to run the Service. You confirm that you have the right to use every photo you upload and the consent of every person shown in it.

Creations are generated by artificial intelligence. They are for entertainment: they are not a prediction of how anyone looks or will look, and they may be inaccurate or unexpected. You may use your creations for your own personal purposes. We keep your creations for 30 days; save the ones you want to keep. You can delete them sooner, and all your data at once, as described in the Privacy Policy.

5. What you may not do

  • upload photos of people without their consent, or use the Service to deceive, impersonate or harass anyone;
  • create sexual, violent, hateful or otherwise illegal content, or any sexual content involving minors;
  • infringe anyone’s copyright, trademark, privacy or other rights;
  • interfere with the Service — automate requests, get around its limits, probe its security, or copy, resell or reverse engineer it.

6. The Service

The Service, its design, styles and content (other than your photos) belong to us or our licensors. We grant you a personal, revocable, non-transferable licence to use it under these Terms. We may change, suspend or stop the Service or any part of it, and we may update the styles it offers.

7. No warranties and limitation of liability

The Service is provided “as is”. We do not promise that it will be uninterrupted or error-free, or that any creation will meet your expectations. To the extent the law allows, we are not liable for indirect or consequential damages, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits rights you have as a consumer that cannot be limited by agreement.

8. Applicable law and disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not take away the protection of the mandatory rules of the country where you live. We will try to resolve any dispute amicably first; otherwise it is decided by the Court of Amsterdam, the Netherlands, unless mandatory law entitles you to a court elsewhere.

9. Changes and contact

We may update these Terms; the date at the top shows the latest version, and continuing to use the Service after a change means you accept it. Questions: [email protected].
